The City of Fayetteville AR uses Automated Merchant Services, Inc. (AMS) for eUtility credit and debit card processing. More information about AMS can be found at https://www.automatedmerchant.com/.

Payment Authorization

Credit Card, Debit Card and electronic check payments to your utility account shall not exceed $10,000, processed within any fifteen (15) day period. Customer may be charged a transaction fee by his/her financial institution. Customer agrees to allow the City of Fayetteville AR to charge the amount indicated by Customer to the financial institution and account indicated by Customer. City of Fayetteville AR is not responsible if Customer’s financial institution rejects payment. If payment is not successful, additional fees may apply and service may be subject to termination.

Customer understands by enrolling in the City of Fayetteville AR online billing, Customer enters into an agreement with the City of Fayetteville AR whereby Customer agrees to view and pay for only those account(s) to which Customer is authorized.

Partial Payments

Partial payments are acceptable, however, our acceptance of such payments is not to be construed as an acceptable payment arrangement that automatically extends your account beyond the normal disconnect date. Our acceptance of late or partial payments will not constitute a waiver of any of our rights to collect the full amount due under this Agreement. If you are unable to pay an invoice in full prior to the due date, please contact customer service prior on this due dare.

Privacy Policy

This policy also describes other important topics relating to your privacy. We reserve the right to modify this privacy policy at any time. Information Collection

We will only collect personally identifiable information (such as name, title, company name, address, telephone number or e-mail address) that you voluntarily provide through our Web site or e-mail correspondence. Before we collect any personally identifiable information, we will provide an explanation for the possible use of your data. Refund Policy

Overpayments made by the Customer will be credited to the designated utility account and apply to the following billing period. In the event that your credit card was charged in error, requests for refunds or adjustments should be made within thirty (30) days of the original transaction. The period of thirty (30) days begins from the transaction processing date. We reserve the right to revise this policy at any time.

Legal Statement

Customer agrees to waive any liability against City of Fayetteville AR for any act or omission arising out of the use of City of Fayetteville AR online billing, unless caused by City of Fayetteville AR’s gross negligence or willful conduct. Customer agrees to not transmit any computer virus or messages that could damage City of Fayetteville AR’s system.

Customer agrees to be bound by these Terms & Conditions, applicable tariffs, state and federal rules and regulations, laws, any rules and regulations of a fund transfer system used by the City of Fayetteville AR.

CITY OF FAYETTEVILLE AR MAKES NO WARRANTIES, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO THE EQUIPMENT OR SERVICE AND EXPRESSLY DISCLAIMS WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND PROVIDES THE EQUIPMENT “AS IS”.

Customer agrees that he/she cannot assign or transfer the Terms & Conditions at any time without written consent from Fayetteville AR.

These Terms & Conditions shall be subject to and interpreted in accordance with the laws of the State of Arkansas and venue shall only be the Courts of Fayetteville AR.

Any unauthorized disclosure, copying, distribution of the proprietary information within the City of Fayetteville AR online billing is prohibited and may be unlawful.

Fees

The City of Fayetteville AR does not charge you any fees for using the Online Utility Bill Pay Service. However, your Financial Institution may charge you fees related to your Credit Card, Debit Card, or electronic check transactions, including transaction fees or fees for attempting transfers without sufficient funds. If a transaction is not honored by your bank a fee may be charged to your City of Sunnyvale account.

Governing Law

This Agreement shall be governed by the law of the State of Arkansas without regard to its conflicts of laws provisions and any action or lawsuit related to this Agreement will be adjudicated in a court of competent jurisdiction in the County of Washington County.

Online Website Statement Disclosure

I hereby authorize AMS, on the behalf of The City of Fayetteville AR to initiate a charge or debit entry on my credit card, debit card or deposit account (as applicable) in an amount equal to the current outstanding balance of my City of Fayetteville Utilities customer account. I acknowledge the origination of a charge or debit entry to my account must comply with the provisions of U.S. law. This authorization will remain in full force and effect until the date upon which the City of Fayetteville AR has received notification from me of my election to terminate this authorization in such time and in such manner as to afford the City of Fayetteville AR and my financial institution a reasonable opportunity to act on it. Such written notification must be submitted through this online recurring payment tool.
